Dog Bite Overview

Section 3342 of California Civil Code includes California’s strict liability laws regarding dog bites. In section 3342a, it states: “The owner of any dog is liable for the damages suffered by any person who is bitten by the dog while in a public place or lawfully in a private place, including the property of the owner of the dog, regardless of the former viciousness of the dog or the owner's knowledge of such viciousness.”

This law serves to protect dog bite victims who have been bitten by dogs who have not previously bitten and/or injured a person. Some states require a dog to have previously injured another person or require an owner to have knowledge of a dog’s vicious nature in order for the victim to seek payment for damages.
